Workers Compensation Rights

If you have suffered an injury or a psychological condition due to police work, you are exempt from the significant amendments made to the NSW Workers Compensation Scheme in 2012. These amendments resulted in a dramatic reduction in potential compensation available for other injured workers. However, the rights of police officers were not affected. Accordingly, you may have rights to:-

  • compensation for permanent impairment
  • compensation for pain and suffering
  • multiple claims for permanent impairment and pain and suffering
  • weekly benefits while you can’t work or can only perform suitable duties
  • medical and treatment expenses for life.
  • travel expenses
  • domestic and nursing assistance (if your level of impairment is 15% or more)

Work Injury Damages Claims

If your injury or condition was caused by negligence (an unsafe system of work), you may also have the ability to bring a claim for work injury damages.

This type of claim can result in you receiving a tax-free lump sum of damages for past and future loss of earnings, superannuation and any tax you have paid on your weekly benefits.

Generally, a 3 year limitation period applies, which can be extended in certain circumstances. Therefore, it is important that you obtain legal advice as soon as possible.

Death benefits

If an officer dies as a result of a work accident or injury, the officer’s dependants or his/her estate can bring a claim for the cost of funeral expenses, a lump sum death benefit and potentially ongoing weekly benefits. At present, the lump sum death benefit is $810,050.

Legal costs are paid by the workers compensation insurer. In addition, we will fund the cost of obtaining any necessary reports or records. We recover those expenses from the insurer at the conclusion of the claim.

Total and Permanent Disablement Claims

If you are a member of the First State Super Blue Ribbon Scheme you will have Total and Permanent Disablement (TPD) coverage. A TPD benefit is a type of insurance policy attached to your superannuation fund.

In order to be eligible to receive the benefit, it is necessary to satisfy the insurer that you have been off work through illness or injury for 6 consecutive months and you are unlikely to ever engage in or work for gain or reward, in any occupation or employment for which you are reasonably qualified by reason of education, training or experience.

The value of the TPD benefit is calculated as a multiple of your salary. The multiple application to you is determined by your age as at the date of disablement.

To make a claim for a TPD benefit you must complete a number of forms and provide medical evidence. It is important that you obtain assistance from one of our expert lawyers right from the beginning. Income Protection Claims

“Income Protection” is monthly income protection insurance.

You may be eligible for income protection benefits if:-

  • you have been totally or partially disabled for the waiting period; and
  • you are disabled at the end of the waiting period; and
  • your pre-disability income is reduced due to your disability

The maximum waiting period and how long you are entitled to receive the income protection benefit will depend on whether you are on duty or off duty when the illness or injury occurs.

Section 181D notices

Pursuant to section 181D of the Police Act 1990, the Commissioner of Police can remove an officer from the NSW Police Force if the Commissioner does not have confidence in the officer’s suitability to continue.

The Commissioner must have regard to the officer’s competence, integrity, performance or conduct when making such a decision.

Prior to making a decision to remove an officer, the Commissioner is required to serve a notice on the officer and include any material which may support a decision to remove him or her.

The officer is then entitled to lodge a response to the notice. This usually involves setting out the reasons why the Commissioner should not remove the officer. The response must be lodged within 21 days of receiving the notice.
