 Compensation 

How do we charge for a compensation claim?

We understand that many people often suffer financial hardship as a result of being injured. At RMB we are sympathetic to such situations and do our utmost to try and assist people through difficult times.

Many injured people who often have a valid claim, do not pursue it as they are concerned about the legal costs they may incur.

NO WIN – NO FEE

NO WIN NO FEETo assist you, RMB Lawyers will conduct an assessment of your claim on a "no win – no fee"* basis. If you have a valid claim to pursue, it is likely that we will offer to act for you on the basis that you will not have to pay for our highly specialised services unless your claim is successful.

That is, you will not be required to pay for our services until your claim has resolved and the compensation has been received.

If your claim is successful, the insurance company will also be required to pay for the vast majority of the legal fees and the expenses incurred in pursuing your claim.

Further, our charges are not based upon a percentage of what you receive – it is illegal for any Australian lawyer to charge fees this way. We only charge fairly for the work we actually perform.

Payment of Expenses

If your are suffering from financial hardship, as a further offering to ensure that your claim progresses as quickly and as smoothly as possible, RMB Lawyers may fund the expenses necessary to pursue your claim. These expenses usually include doctors report fees, Court filing fees, expert report fees and the cost of obtaining your medical and other records.

In some cases, such as complex claims involving medical law, we may ask you to fund the initial medical report fee required to determine whether or not you have a valid claim.

From the outset, we will discuss with you any potential fees payable by you. This will happen before you agree to be our client.

Workers Compensation Claims

If you have a workers compensation claim, RMB Lawyers will arrange a grant of legal assistance for you through the Workers Compensation Independent Review Office (WIRO). For approved claims, WIRO will pay your legal fees and expenses. This means that any compensation to which you are entitled is not affected by the cost of pursuing the claim.

Written Disclosure

It is important to us that all of our clients are well informed and fully understand how our fee arrangements operate. Our arrangements are always fully disclosed in writing and the document is explained in detail. We will also give you an estimate of what our fees are likely to be.

A 5 day cooling off period also applies if you change your mind.

How does RMB charge for Business Disputes?

In accordance with the requirements of the Law Society of New South Wales we are required to send you our Service Agreement setting out our hourly rate, together with an estimate of what we believe the matter will cost.

RMB offers various methods of payment for our work depending on the circumstances of the parties to the dispute.

Some of those methods are set out below:

NO WIN – NO FEE

NO WIN NO FEEAt RMB we are sympathetic to claims where people suffer financial hardship and we do our upmost to try and assist people through these difficult times.

Many people have a valid claim, but they are often unable to pay as they go for the work that we do.

Depending on the merits of the case, we will often agree to be engaged on a "no win – no fee" basis.

To be engaged on this basis, we will initially conduct an assessment of your claim.

No win – no fee means that you are not required to pay for our services, until your claim is resolved, and only if you are successful.

Please note our fees are not based on a percentage of what you receive. It is illegal for a lawyer in New South Wales to charge through this way. We only charge for the work that we actually perform.

Retainer

An agreed retainer to start proceedings then no win – no fee basis.

Fixed Fee

We also in the appropriate case will consider acting for you on a fixed price basis to give you some certainty.

We also in the appropriate case will act for you on a fixed base retainer, up until a certain time, where we can in the right case act for you from that point on a no win – no fee basis.

Hourly Rates

Our hourly rates are modest in comparison to many law firms. Most of our business is located in regional Australia and this helps us to keep our cost base sensible.
