Total & Permanent Disablement Claims

If you are unable to work due to any condition, illness or injury, you may be able to make a claim for a total and permanent disability (TPD) benefit.

This type of benefit is usually attached to your superannuation fund account. At times, certain types of life insurance policies can also have a TPD benefit attached to them.

The value of the potential TPD benefit will be determined by the type of policy you have. However, if your claim is successful, you will receive a lump sum payment, regardless of any earnings which you are receiving. Generally, in order to qualify for this type of benefit we will need to help you prove that it is unlikely that you will ever be able to return to your job or any other form of employment for which you are suited by way of education, training or experience. This claim may be available to you even if you are able to gain some other form of work, rather than your normal job.

Normally, you need to have been unable to work for at least six months before you become eligible to lodge an application. However, it is advisable to begin the process as soon as possible if it is likely that you will be unable to return to work or your normal job

In order to lodge the claim, we will obtain the relevant application forms from the fund provider, work with you to complete them and also gather medical evidence which is required in order to prove that you are unlikely to be able to return to your normal work. No two TPD claims are the same.

There will be claim forms, medical reports and other documents to lodge.

It is important that you obtain assistance from one of our expert lawyers right from the beginning. Any error made in completing the claim form or in the provision of unsupportive medical reports could see your claim fail.

In general, the claim process takes four to twelve months. RMB Lawyers are well established experts who have the necessary experience to pursue your claim.

As with all of our compensation services, we are prepared to help you on a 'no win/no fee' basis. This means you won't have to pay for the work we do on your behalf unless we bring a successful claim for you, and you receive a lump sum benefit.
